These Terms of Service govern your access to SecondOpinion.org and your purchase or use of its services. SecondOpinion.org is operated personally by Sunny Jain, MD. By using this website, submitting a request, checking an agreement box, or making a payment, you agree to these Terms, the Privacy Policy, the Medical Disclaimer, and the Refund Policy.
Nature of the Service
The Independent Medical Case Review is a retrospective, educational review of medical information and records that you choose to provide. It is intended to help you better understand completed medical care, the documented clinical timeline, and questions you may wish to discuss with an appropriate treating professional.
The service does not include a physical examination, diagnosis, treatment, prescription, medical order, referral, monitoring, ongoing clinical management, or management of an emergency or current medical condition. It is not telemedicine and does not establish a physician-patient relationship.
Emergencies and Current Medical Care
Do not use this website or service for an emergency, urgent medical concern, or time-sensitive treatment decision. Call 911, go to the nearest emergency department, or contact an appropriate treating clinician immediately.
Do not delay or change medical care, medications, testing, follow-up, or treatment based on information from this service.
No Legal Advice or Malpractice Determination
The consumer Independent Medical Case Review does not provide legal advice and does not determine negligence, malpractice, legal causation, damages, case value, or whether a legal claim should be filed.
The $350 website service is for personal and educational use. It does not include an expert report, affidavit, declaration, testimony, deposition, litigation opinion, attorney-directed analysis, or consultation with legal counsel. Attorney and expert-witness services require conflict clearance and a separate written engagement agreement.
Eligibility and Authority
You must be at least 18 years old to submit or purchase a service.
You may provide information or records only if you are the patient or are legally authorized to act for the patient, including as an authorized parent, guardian, personal representative, or attorney. By submitting information, you represent that you have the authority and permission necessary to provide it for review.
Do not submit another person’s information or records without appropriate authorization.
Accuracy and Completeness
You are responsible for providing information that is accurate, complete, and not misleading. The review will be based solely on the information and records made available. SecondOpinion.org does not independently verify every fact, interview treating clinicians, or obtain records from healthcare facilities unless separately agreed in writing.
Missing, incomplete, illegible, altered, or inaccurate information may limit the review or change its conclusions. New information may also change an earlier assessment.
Medical Information and Records
The initial intake form is intended only for a brief general summary. Do not include a patient’s name, date of birth, medical-record number, Social Security number, insurance information, or complete medical records in the intake description.
Do not send medical records until you receive specific instructions. Ordinary email may not be encrypted end to end. SecondOpinion.org does not represent that the website or ordinary email is HIPAA-compliant. If you choose to communicate or transmit information by ordinary email, you acknowledge its security limitations.
Information is otherwise handled as described in the Privacy Policy.
Acceptance or Declination of Requests
Submitting a form and making a payment do not guarantee that a request will be accepted.
SecondOpinion.org may decline or discontinue a request when it involves an emergency or active treatment decision, falls outside the reviewer’s expertise, presents an actual or potential conflict, lacks adequate authorization or records, requests an inappropriate or unlawful service, or cannot be completed responsibly.
Declining a request is not a medical judgment about the seriousness or merits of the underlying matter.
Fees and Refunds
The applicable fee is displayed before purchase.
You will receive a full refund if SecondOpinion.org declines your request before substantive review begins. You will also receive a full refund if you cancel before substantive review begins.
Substantive review begins when the physician starts reviewing the supplied medical records or preparing the analysis. After substantive review begins, the fee is generally nonrefundable because professional time has been committed. Disagreement with the conclusions or dissatisfaction with the outcome does not by itself create a right to a refund.
Any additional refund rights are governed by the Refund Policy and applicable law.
Estimated Completion Time
Any stated completion time, including an estimate of three to five business days, begins only after the request has been accepted and all requested, usable records have been received.
Completion times are estimates, not guarantees. Complex cases, large record sets, missing information, technical problems, or the need for clarification may require additional time.
Nature and Limitations of the Review
The review reflects an independent educational assessment based on the materials provided. It may identify documented facts, clinical considerations, unanswered questions, or issues that may warrant discussion with a treating clinician or attorney.
No particular conclusion, outcome, diagnosis, legal result, refund from another provider, or improvement in health is promised or guaranteed.
The review is not a substitute for an in-person evaluation or advice from a clinician who is responsible for your current care.
Permitted Use
You may use the completed review for your personal educational purposes and may share it with your treating clinician or attorney for discussion.
You may not present the consumer review as a formal expert opinion, sworn report, medical certificate, diagnosis, treatment plan, or litigation testimony. You may not alter it in a misleading manner, misrepresent its purpose, impersonate another person, use it unlawfully, or publish or sell it for commercial purposes without written permission.
No third party is entitled to rely on the review as professional medical or legal advice.
Intellectual Property
The website’s design, text, graphics, educational materials, and other original content are owned by SecondOpinion.org or their respective licensors and are protected by applicable intellectual-property laws.
After full payment, you receive a limited, nonexclusive, nontransferable license to use your completed review for the permitted purposes described in these Terms. Ownership of the underlying professional work product and general methods is not transferred.
Website and Third-Party Services
The website may use third-party services for hosting, forms, payment processing, analytics, communications, and other functions. Those services may have their own terms and privacy practices.
SecondOpinion.org is not responsible for temporary outages, failures, or actions of independent third-party services beyond its reasonable control.
Disclaimer of Warranties
To the fullest extent permitted by law, the website and services are provided on an “as available” basis. No warranty is made that the website will always be uninterrupted or error-free or that a review will answer every question or produce a particular result.
Nothing in these Terms limits any warranty or consumer right that cannot lawfully be excluded.
Limitation of Liability
To the fullest extent permitted by law, SecondOpinion.org and Sunny Jain, MD will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from use of the website or service.
To the extent permitted by law, total liability for a claim arising from a purchased consumer review will not exceed the amount paid for that review.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by law, including liability arising from gross negligence, willful misconduct, or fraud.
Suspension or Termination
Access may be suspended or terminated if you violate these Terms, misuse the website, threaten or harass others, submit unauthorized information, attempt fraud, or request an unlawful or professionally inappropriate service.
Any refund following termination will be determined under the Refund Policy, the work already performed, and applicable law.
Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles, while preserving any mandatory consumer protections that apply to you.
Any dispute that cannot be resolved informally will be subject to the jurisdiction of the appropriate state or federal courts in Massachusetts.
Changes to These Terms
These Terms may be updated prospectively. The updated version will be posted with a revised date. The version in effect when you purchase a service will generally govern that purchase unless a change is required by law.
Severability and Entire Agreement
If any provision is found unenforceable, the remaining provisions will remain in effect. These Terms and the policies incorporated into them constitute the entire agreement concerning the consumer website service unless a separate written agreement applies.
